Rules and Regulations

In accordance with Chapter 350A.5 of the Code of Iowa, the Sioux County Conservation Board hereby adopts the following Rules and Regulations for the protection, control, and regulation of all areas under the jurisdiction of said Board.

1. DEFINITONS

“Board” when used herein shall mean the Sioux County Conservation Board.

“Officer” when used herein shall mean all employees so designated by the Board.  Said Officer shall have all powers conferred, by law, on police officers, peace officers, and sheriffs, in the enforcement of the following rules and regulations, the laws of the State of Iowa, and the apprehension of violators thereof.

“Area” when used shall mean all parks, preserves, playgrounds, wildlife areas, camping areas, and other recreational lands, waters, buildings and facilities owned, leased or otherwise controlled or governed by the Sioux County Iowa Conservation Board.

2. PERSERVATION OF PROPERTY & NATURAL RESOURCES

No person shall injure, deface, disturb, befoul, or in any manner destroy or cause to be destroyed, any part of any area, or any public buildings, signs, structures, equipment, or other property found therein.  It shall be unlawful to remove, injure, or destroy any tree, flower, shrub, plant or any other vegetation, and the fruit thereof, or any rock, sand, earth, wood, or other natural materials in any area, except that upon special permission of the Board or its officer, certain species may be removed for scientific purposes.

3. WILDLIFE/HUNTING

It shall be unlawful to kill, hunt, trap, pursue, or in any manner disturb or cause to be disturbed, any bird or animal within any area except in game management areas or other areas so designated by the Board, Subject to Iowa law.  The privilege of hunting in a game management or such other designated area, may be revoked by any officer for unsportsmanlike like conduct, violation of Iowa law, or these rules and regulations, or other just causes.  Some restrictions may apply to regulation hunting or method of take.  Make sure you read posted materials or county administration rules.

4. FISHING

Fishing is permitted in or upon any waters adjacent to areas under jurisdiction of the Board, subjected to county posted limits & rules and to Iowa law.  The privilege of fishing within a county area may be revoked by any office, for unsportsmanlike conduct, violation of Iowa law, or these rules and regulations, or other just causes.

5. TRAFFIC

The maximum speed limit of all vehicles within a county area shall be no greater than 15 miles per hour.  All driving shall be confined to designated roadways.  All vehicles shall be parked in designated parking areas, and no vehicle shall be left unattended on any roadway except in case of emergency.  Excessively loaded vehicles are prohibited.  Determination as to whether the load is excessive will be made by the board or its officer, and will depend upon the load and road conditions.  Motorized bikes, scooters, and cycles may be used as a means of conveyance to an area, provided conveyance is upon a designated roadway.  However, unwarranted and indiscriminate “cruising” within an area is prohibited.

6. FIRES

No fires shall be built, except in a place provided therefore, or within users equipment upon approval of the board or its officer.  It shall be unlawful to start or cause to be started any ground fire whatsoever in any location within an area or to cut any firewood except upon special permission of the board or its officer.

7. FEES

The board is hereby authorized to fix fees for camping and other special privileges which shall be in such amounts as may be determined by the board upon a basis of the cost of providing and reasonable value of such privileges.  The board reserves the right to establish such fees without notice.  An additional fee may be enforced for any damaged or missing equipment.

8. CAMPING

Camping is permitted only in areas and locations so designated by the board or its officer.  All campers shall register with the attending officer upon arrival.  Loud talk, radios and other excessive noise shall be discontinued after 10:30p.m.  No camping unit shall be permitted to camp for a period longer than that designated by the board or its officer.

9. DISPOSAL OF REFUSE

No person shall deposit or abandon, in any area or adjacent waters, any garbage, sewage, refuse, trash, waste, or other obnoxious or offensive material, except in receptacles or pits provided for such purpose.

10. CLOSING HOURS

All persons, except campers and those with permission granted by the board or its officer, shall vacate county areas between the hours of 10:30 p.m. and 7:00a.m. of the following day.  Closing hours other than the above may be adopted by the board for certain areas or portions thereof and posted in a conspicuous place.

11. FIREARMS & WEAPONS

No firearms, air rifles, paintball guns, slingshots, bows and arrows, or flammable or explosive material or other dangerous articles, or substance shall be used or kept or permitted in any area except in those areas or parts thereof designated for the use of the above mentioned arms and substances.  This provision shall not apply to any officer or employee of the board.

12. CONDUCT

It shall be unlawful for any person to sell, possess, use, consume, or otherwise in any manner to have liquor, keg beer or drugs, in or on any county area.  Unruly demonstrations, disturbing of the peace, unseemly conduct, threatening, abusive, insulting, profane, or indecent language are prohibited.

13. SWIMMING

It shall be unlawful to use any waters, under the jurisdiction of the board, for the purpose of swimming.  Except for the Big Sioux Recreation Area & Sandy Hollow Recreation Area where posted.

14. WINTER ACTIVITES

Skiing, tobogganing, and snowmobiling may be permitted in areas or portions thereof so designated by the board.  All equipment used for such activities must be in compliance with Iowa law and approved by the board or its officer.

15. BOATING

All boats shall be equipped and operated in accordance with Iowa law.  Where ramps are provided for the launching of boats, said ramps are to be promptly cleared upon launching or recovering a boat, to permit others to use the facilities.

16.   ATV

ATV’s are not allowed on any area unless SCCB or its officer has designated it for the use.

17.  DOMESTIC ANIMALS

No privately owned animals shall be allowed to run at large in or upon any area.  Such animals shall be carried, led by a leash or chain, not exceeding six feet in length, or kept confined in, or attached to the owners vehicle.  No animal shall be hitched, tied or attached in any way to any tree, shrub, or other natural attraction, or structures provided by the board.  Riding horses may be permitted in designated areas or portions thereof, upon proper registration with the attending officer.

18.  PEDDLING & ADVERTISING

Peddling, hawking, soliciting, begging, advertising, or carrying on of business or other commercial enterprise with in any area without written permission of the board is prohibited. No person shall post, paste, fasten, paint or affix any placard, bill, notice, or sign upon any structure, tree, stone, fence, thing, or enclosure along or within an area.

19.  CLOSING OF AREA

Any area or portion thereof may be entirely or partially closed to certain uses or any use by the public at any specified period of time as may be determined by the board or its officer.  During such period of time, it shall be unlawful for any person to enter upon or occupy such areas or portions thereof, except by special permission of the board or its officer.

20.  BUILDING & EQUIPMENT

Upon vacating an area, all structures, facilities within and surroundings shall be left in a clean and sanitary condition.

21.  REFUSAL TO ISSUE A PERMIT

The board reserves the right to refuse usage of any area or portion thereof, to an individual or group, for any reason whatsoever.

22.  PENALTIES

Any person violating any of the provisions of the foregoing sections shall upon conviction be fined not to exceed $100.00 and, or be imprisoned in the county jail not to exceed thirty days.

23.  LIABILITY

The board and its officers assume no responsibility for death or injury of any person within a county area.  Persons using a county area do so at their own risk.
